====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 03.12.2018 in a case for the offence registered under Sections 147, 148, 149, 387, 427, 506 of the IPC, 3, 4, 5 of Explosive Substance Act and 17 of C.L.A. Act.

The prosecution story, in brief, is that a construction work of one 'Haque Construction Company' for construction of one Bridge was going on in between Shekha Bigha and Alhua Chak within the Amas Police Station in which the informant was one of the partner and the said work was being done by him. On 28.06.2017 at about 11.00 A.M., the petitioner alongwith his five men came with some explosive substance and demanded levy, attacked and tried to blast the Bridge with detonator. Patna High Court CR. MISC. No.16253 of 2019(4) dt.24-07-2019 2/2 occurrence, firing was also made several time over the site of the informant and for which F.I.R. was lodged and oral threatening was being given to the informant and his son to face consequences.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. He has remained in custody for more than six months. None is said to have been injured in course of occurrence.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati, Gaya, in connection with Amas P.S. Case No. 129 of 2017.
