The petitioners apprehend their arrest in connection with Dighwara P.S. Case No. 353 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Further submission is that from perusal of the seizure list, it would be evident that the illicit liquor has been recovered between railway line and road. Nothing has been recovered from the conscious possession of the petitioners.

No.17248 of 2023(2) dt.05-05-2023 2/2 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge Excise, Saran at Chapra in connection with Dighwara P.S. Case No. 353 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
