JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in a case registered for the offences punishable under Sections 272, 273, 420, 467, 468, 471, 120/ 34 of the Indian Penal Code and Sections 30(A), 41(1) of the Excise Act.

The learned counsel for the petitioners submits that the petitioners are in custody since 26.12.2021, they are persons with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 2260.80 litre of liquor along with mobile and Rs.5350/- from a container.

They are neither the owner of the truck, nor they were present on the truck rather they were passer-by, who came to be implicated when search was being made.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and chargesheet has been submitted in this case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanti P. S. Case No.821 of 2021.

The application stands allowed.
