The petitioner is languishing in jail since 11.8.2015 in a case registered for the offence punishable under section 21(b) of the N.D.P.S.Act.
From the possession of the petitioner 21 sachets weighing 5.69 grams of brown sugar were recovered.
It is submitted by the learned counsel for the petitioner that the recovery was made merely on suspicion though the petitioner is accused in two other cases of similar nature. Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with N.D.P.S. Case No. 10/2015 arising out of Ara (T) P.S.Case No. 361/2015 pending in the court of Sessions Judge, Ara, Bhojpur. This application is, accordingly, rejected.
Patna High Court Cr.Misc. No.22037 of 2016 (3) dt.21-06-2016 The petitioner will be at liberty to renew his prayer for bail after six months.
