The petitioners, two in number, apprehend their arrest in a case under Section 406 and 420 of the Indian Penal Code.

The complainant made allegation that the petitioners took money from him for selling their house. They also executed a deed of agreement to sell but the petitioners refused to execute the sale deed nor did they return the money. It is submitted that the petitioners never took any money from the complainant. The complainant forged the deed of agreement to sell. The petitioners filed Complaint Case No. 327/13 fifteen days ago to the complaint petition filed by the complainant.

Considering the fact that the petitioners disputed the

No.26609 of 2015 (2) dt.20-07-2015 2/2 deed of agreement to sell and the dispute appears to be civil in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar Singh, Judicial Magistrate, 1st Class, Dehri-on-sone, District Rohtas in Complaint Case No. 354/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
