JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in connection with Bihta P.S. Case No. 300 of 2014 for the offences instituted under Sections 147, 149, 341, 323, 307 and 302 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 08.05.2014 around 3.13 when the informant was playing in the orchard the accused persons came and got into altercation assault resulting into death.

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. Further it has been submitted that the name of the petitioner has come in course of investigation. It is further submitted that no specific allegation has been made

Patna High Court Cr.Misc. No.28754 of 2015 (2) dt.23-07-2015 2/2 against the petitioner. It is further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bihta P.S. Case No. 300 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
