JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-11-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 09.02.2017 passed Cri. Misc. No. 34286 of 2016, on the ground that the petitioner is suffering in custody since 30.06.2015, there was direction to conclude the trial within six months but the trial has not been concluded and the petitioner was given liberty to renew his prayer for bail and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of bail by submitting that the petitioner is the husband and there is allegation for committing murder of his wife and further dead body of the

Patna High Court Cr.Misc. No.54967 of 2017 (2) dt.22-11-2017 2/2 deceased was recovered near Daini river.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail at this stage again prayer of the bail of the petitioner stands rejected. However, the learned trail Court is directed to expedite the trial and to conclude the same preferably within three months, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
