The petitioner apprehends his arrest in Amba P.S. Case No. 33/2015, registered for the offences punishable under Sections 409, 420/34 and other Sections of the Indian Penal Code. The petitioner is said to have misappropriated the rice worth Rs. 1,19,36,976/- after lifted paddy for milling. It is submitted that the petitioner did not violate any terms and conditions of the agreement. Certificate case is also pending. The BSFC did not lift the rice from the godown of the petitioner nor provided transportation but the petitioner is ready to deposit 20% of the total amount i.e. 1,19,36,976/- within seven

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Amba P.S. Case No. 33/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

If the petitioner fails to deposit the aforesaid amount within seven months from the date of receipt of this order, the bail bond of the petitioner shall be cancelled.
