2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 323 , 341 , 302, 506 and 34 of the Indian Penal Code .
3. As per FIR, it is alleged that these petitioners along with other co-accused persons assaulted the husband of the informant due to which he died during course of treatment .
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this case. Specific accusation of causing death of the husband of the
Patna High Court CR. MISC. No.21854 of 2024(2) dt.04-04-2024 2/2 informant is against co-accused namely Ajay Kumar @ Sonu who is son of petitioner No. 1 and brother of petitioner Nos. 2 and 3 . There is no specific allegation of assault against these petitioners. Petitioners are ladies and claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM IX, Bhagalpur in connection with Ishakchak P.S. Case No. 252 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
