ANJANA MISHRA ORAL ORDER 18-07-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 19.05.2018 in connection with Khagaria P.S. Case No. 311 of 2018 for the offence registered under Sections 366 (A)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the first information report, the daughter of the informant namely, Priyanka Kumari in her statement under Section 164 Cr.P.C. has categorically stated that she had left her home in her sweet will and the petitioner was not known to her though they are studying in the school. It is further submitted that she has not alleged anything against the present petitioner.

Patna High Court Cr.Misc. No.42435 of 2018 (2) dt.18-07-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 311 of 2018.
