2. In the present case, the petitioner seeks bail in connection with Belchi P.S. Case No.10 of 2024, registered for the offences under Section 364(A) of the IPC.

3. As per the prosecution case, the minor son of the informant was kidnapped and ransom demand of Rs.4,00,000/- was made. The name of the petitioner transpired during investigation for being involved in the occurrence.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR and his name came up during investigation in confessional

Patna High Court CR. MISC. No.19625 of 2025(4) dt.23-07-2025 2/3 statement of Biranchi Kumar. Except for the confessional statement of two co-accused persons, there is nothing against the petitioner. Biranchi Kumar named this petitioner for being involved in the present case due to village politics. Earlier this Court granted anticipatory bail to co-accused Tetraj @ Chotu Kumar and Rabindra Paswan in Cr. Misc No.39406 of 2024 and Cr. Misc. No.42318 of 2024, respectively. Learned counsel for the petitioner further submits that from the statement of victim, it appears that victim has named only co-accused, Biranchi Kumar and the name of this petitioner was subsequently added. The petitioner is having no criminal antecedent and he is in custody since 07.11.2024 and charge-sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the doubtful nature of allegation against the petitioner and also considering the clean antecedent of the petitioner along with his period of custody and also submissions of charge-sheet the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.19625 of 2025(4) dt.23-07-2025 3/3 learned SDJM, Barh/concerned court, in connection with Belchi P.S. Case No.10 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
