JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364, 365, 367, 326 and 307 of the Indian Penal Code.

The prosecution case is that the informant was taken by the accused persons on the pretext of going to Ram Nawami fair but the informant was taken to the house of the petitioner where the informant was brutally assaulted.

It is submitted by learned counsel for the petitioner that the accusation has been levelled on the basis of suspicion. For the occurrence of 08.04.2014, the FIR was registered on 26.06.2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration

Patna High Court Cr.Misc. No.33055 of 2015 (2) dt.13-08-2015 2/2 of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sahebganj P.S. Case No. 189 of 2014 pending in the court of learned CJM, Muzaffarpur. Accordingly, the application is disposed of.
