JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2019 The petitioner seeks bail in anticipation of her arrest in connection with Khagaria (Muffasil) P.S. Case No. 484 of 2016, dated 05.08.2016, which though was registered for the offences under Sections 341, 323, 307, 354, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act, but as against the petitioner, cognizance has been taken only under Section 354 of the Indian Penal Code.

No.16015 of 2019(2) dt.15-03-2019 2/2 It appears from the records that after investigation the petitioner was not sent up for trial, but differing with the police report, cognizance has been taken against the petitioner under Section 354 of the Indian Penal Code. Regard being had to the nature of accusation against the petitioner and taking into account the fact that the petitioner is a women, she, in the event of her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 484 of 2016, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
