The petitioner apprehends his arrest in a case under Section 392 of the Indian Penal Code.
The petitioner is not named in the FIR. The name of petitioner was figured in the confessional statement of co-accused Deepak Kumar Tiwary @ Sonu Tiwary and Vikash Kumar Singh @ Piyush Kumar Singh. Nothing has been recovered from the possession of the petitioner.
It is submitted that similarly situated accused Amit Kumar Singh @ Amit Kumar Roy whose name also figured in the confessional statement of co-accused Deepak Kumar Tiwary @ Sonu Tiwary and Vikash Kumar Singh @ Piyush Kumar Singh
Patna High Court Cr.Misc. No.29451 of 2015 (2) dt.27-07-2015 2/2 has already been enlarged on bail vide order passed in Cr. Misc. No. 17627 of 2015 and case of the petitioner stands on the same footing.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Mirganj P.S. Case No. 323 of 2014 (G.R. No. 3618/2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
