Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Complaint Case No. 474 of 2020 (Trial No. 4464 of 2020) registered for the offence punishable under Sections 420, 120-B, 500 of the Indian Penal Code.

Learned counsel for the parties have agreed that the matter is to be settled between the parties and the petitioners will pay Rs.40,000/- to the opposite party no.2 in the Court

Patna High Court CR. MISC. No.27642 of 2021(5) dt.29-03-2022 2/2 below by way of a demand draft.

Considering the aforesaid, this bail application is allowed.

Let the petitioners, above named, in the event of their arrest/surrender within eight weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Complaint Case No. 474 of 2020 (Trial No. 4464 of 2020), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is also subject subject to the condition that at the time of furnishing bail bonds, the petitioners shall deposit a demand draft of Rs.40,000/- prepared in the name of the opposite party no. 2. Once the demand draft is deposited, the bail bonds of the petitioners shall be accepted by the Court below. After the informant receives the demand draft, he shall give an undertaking that he shall withdraw the present criminal case.
