JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending his arrest in connection with Makhdumpur P.S. Case No. 287/2014 for the offence instituted under Section 366(A) of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that on 12.8.2014 while the informant's daughter Puja Kumari, age about 16 years, had gone to Tehta market but she did not return. Subsequently, the informant came to know that the petitioner is said to have kidnapped his daughter Puja Kumari for the purpose of marriage. It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in the present case. It is further submitted that the victim girl has been examined under
Patna High Court Cr.Misc. No.26960 of 2015 (2) dt.21-07-2015 2/2 section 164 Cr.PC. where she on her own will, has stated that she has married with the petitioner and has shown her willingness to live with him.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and the statement recorded under section 164 Cr.PC of the victim is Annexure -2 to this application. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Makhdumpur P.S. Case No. 287/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
