JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 379/34 and other allied sections of the Indian Penal Code.
As per the prosecution case, petitioner and other accused persons are alleged to have committed house trespass and theft in the office of the informant in the night. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.
Learned counsel for the State opposes the prayer for bail submitting that petitioner and other accused persons have been seen in the CCTV footage committing the aforesaid offence. Petitioner has got criminal antecedent. Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to
