The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code.
The petitioner lifted 2950 quintals of paddy for milling and he had to deliver 1967.50 quintals of rice, but the petitioner has deposited only 810 quintals of rice thereby the petitioner misappropriated Rs. 25,26,126/-.
Mr. Sumeet Kumar Singh, the learned counsel appearing on behalf of the petitioner submits that the petitioner is ready to pay 20 per cent of the amount within six months. Mr. Shailendra Kumar Singh, the learned counsel appearing for the B.S.F.C. did not raise objection and submits that

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Barun P.S. Case No. 51 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., if the petitioner fails to deposit 20 per cent of the Rs. Rs. 25,26,126/- within six months, the learned court below shall cancel the bail bond of the petitioner.
