Petitioners apprehend their arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.

Petitioners are alleged to have not returned the loan amount of Rs.1 lac given to them by the informant. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. They submit that the present case has been lodged due to local politics and ulterior motive of the complainant. Occurrence is of 21.5.2012 for which complaint has been filed on 24.12.2018. There is no evidence on record to support the allegation against the petitioners as such no case under section 420 of the Indian Penal Code is attracted against them. Petitioners have got no criminal antecedent.

Considering the facts of the case, let the petitioners

Patna High Court CR. MISC. No.16091 of 2020(3) dt.03-09-2020 2/2 named above, in the event of surrender before the Court below within six weeks from the date of receipt of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Complaint case no. 2950/2018, subject to the conditions laid down under sections 438 of the Code of Criminal Procedure.
