NILU AGRAWAL ORAL ORDER 13-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
Petitioner seeks bail in connection with Forbesganj P.S. Case No. 292/2018 for offences registered under Sections 420, 467, 468, 471, 120B/34 of the Indian Penal Code. The prosecution case, as alleged by the police personnel, is that, on information that some persons have assembled in Room No. 105 of Sanchita Hotel, who have come from Delhi to provide jobs under the Swaksha Bharat Mission, the police raided and found incriminating articles such as Laptop, application forms, different types of seals, cheque books and other documents and apprehended five persons including the petitioner, who has been alleged to be present with other co-accused persons and was in possession of touch phone mobile.

No.41432 of 2018 (2) dt.13-07-2018 2/2 It has been submitted by the learned counsel for the petitioner that she is innocent, bears no criminal history and no incriminating article has been recovered from her possession. He submits that except one witness, who has stated that co-accused Kunal Kishore had called him at the hotel and asked him to pay Rs. 500/- and further Rs. 25,000/- for the job, there is no allegation against the petitioner or other co-accused. He further submits that co-accused Kunal Kishore has already been enlarged on bail by a coordinate Bench of this Court in Cr. Misc. No. 38348 of 2018, vide order dated 29.06.2018 and the petitioner is languishing in judicial custody since 26.04.2018.
Learned APP for the State, however, opposes the prayer for bail.
Having considered the aforesaid facts and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 292 of 2018.
