The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 504, 506, 509 and 323/34 of the Indian Penal Code and Section 8/12 of the POCSO Act.
It is a case of indecent act committed by the petitioners against the daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no specific allegation of outraging the modesty of the daughter of the informant and from perusal
Patna High Court CR. MISC. No.17675 of 2022(2) dt.20-09-2022 2/2 of the FIR, it appears that the petitioners have abused to the victim and the case has been lodged after delay of about 20 days. The petitioners are also resident of same village of the informant. He further submits that this case has been filed in the revenge of the resolution of a Panchayat, directing to the informant to pay Rs.10,000/- as compensation in lieu of the death of a cow of one Naresh Manjhi after trapping in the fencing of electrocution of the informant. Petitioners have clean antecedent.
Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-VI, Gaya in connection with Moffassil P.S. Case No. 596 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
