The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 152, 153A, 341, 323, 353, 447, 504, 353, 427, 295, 295A and 298 of the Indian Penal Code. It is alleged that procession of emersion of idol of Goddesses Sarswati was protested by the Muslims community leading to pelting stones from both sides. It is submitted by the learned counsel for the petitioners that accusation is omnibus and general and there are two versions of the same incident and petitioner is accused in only in those two cases.
Considering the accusation being omnibus and
Patna High Court Cr.Misc. No.26764 of 2015 (2) dt.20-07-2015 general, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kurtha P.S. Case No. 13 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
