ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 29.07.2017 in connection with Kotwa P.S. Case No.70 of 2017 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R., but only on the basis of the confessional statement made before the police by a coaccused, the petitioner is facing prosecution and has been arrested. He further submits that till date, he has not been placed on T.I. Parade nor any recovery has been made from his possession.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.58777 of 2017 (2) dt.14-12-2017 2/2 circumstances and also that the similarly situated co-accused Jitendra Sahani has been granted regular bail by this Court in Cr.Misc. No. 55263 of 2017, vide order dated 16.11.2017, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Motihari, East Champaran, in connection with Kotwa P.S. Case No.70 of 2017.
