The petitioner apprehends his arrest in Jalalpur P.S. Case No. 73 of 2019, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, while the informant and his cousin brother were returning from Chapra court and reached at Jalalpur Mahendra Mishra Chowk, all the accused persons including this petitioner and 15 unknown persons assaulted the informant and when his brother tried to save him, he was also assaulted by the accused persons. It is further alleged that this petitioner snatched gold chain from the neck of informant worth Rs. 25,000/-.

There is allegation of assault by five named and fifteen unknown persons, but only two injuries have been found on the person of injured persons. Both injuries are simple in nature. No specific role has been attributed against this petitioner. There is general and omnibus allegation of commission of assault and no specific role has been assigned to the petitioner.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge X, Saran at Chapra in connection with Jalalpur P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
