Case No.467 of 2013.

Apprehending arrest, the petitioner filed A.B.P. No.699 of 2013 before the Sessions Judge, Nawada. The same was dismissed on 20.11.2013. Hence, this application for grant of anticipatory bail under Section 438 of the Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The only allegation against the petitioner is referable to Section 307 of the Indian Penal Code.

It is submitted that no injury was caused to anyone and that one of the accused, namely, Md. Imtiyaz Haider, was granted anticipatory bail by this Court in Cr.Misc. No.53587 of 2013

Patna High Court Cr.Misc. No.53829 of 2013 (5) dt.09-04-2015 2/2 through order dated 30.4.2014. Hence, the application is allowed. In the event of arrest, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Bundelkhund (Nawada Town) P.S. Case No.467 of 2013,subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
