The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 337, 338, 354(A), 354(B), 504, 34 of the Indian Penal Code. Subsequently, Section 302 I.P.C was also added.

The prosecution case as per F.I.R is that all the accused persons brutally assaulted the father-in-law of the informant and when her husband went to his rescue, he was also assaulted. It is alleged against this petitioner that he abused and outraged the modesty of the

Patna High Court CR. MISC. No.27382 of 2021(4) dt.28-06-2022 2/3 informant. The father-in-law of the informant was thereafter taken to the hospital where during treatment, he succumbed to the injuries.

It is submitted by learned counsel for the petitioner that for the alleged occurrence of 31.12.2019, the F.I.R has been registered on 02.01.2020. There is general and omnibus allegation against the petitioner that he along with other co-accused persons abused the informant and outraged her modesty. There is no specific overt act against the petitioner to assault the deceased. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur
