2. The petitioner seeks regular bail in connection with Sakra P.S. Case No. 430 of 2023 registered for the offence punishable under Sections-399, 402 and 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

3. Allegedly, on the tip off, the informant along with police personnel reached at the place of occurrence and apprehended two persons at the spot whereas rest of the accused persons became successful in fleeing away. The specific allegation against the petitioner is that a loaded country-made pistol was recovered from his possession.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.22562 of 2024(6) dt.24-07-2024 2/2 that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 05-09-2023.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances as also the period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, East, Muzaffarpur in connection with Sakra P.S. Case No. 430 of 2023 with following conditions:

(i) The petitioner shall cooperate with the trial and make himself available as and when required by the court. (ii) The petitioner will appear in the court below on each and every date fixed in the case and if, he fails to do so on two consecutive dates unless he is prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
