JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code.

Allegation against the petitioners is that they tortured niece of the informant and lastly she was murdered. It has been submitted on behalf of the petitioners that petitioners have got no criminal antecedents. Petitioner no. 1 is the father-in-law and petitioner no. 2 is the mother-in-law of the deceased. They are separate from mess and property of the husband of the deceased. It is further submitted that there is no eye witness to the occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on

Patna High Court Cr.Misc. No.26893 of 2015 (3) dt.23-09-2015 2 / 2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dalsingsarai at Samastipur, in connection with Ujiyapur P.S. Case no. 28 of 2015 arising out of Complaint Case no. 31 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
