JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2017 Heard learned counsel for the petitioner and learned counsel for the Bihar State Food and Civil Supplies Corporation ltd.
This matter relates to procurement of the paddy which includes handling and transportation charges. Petitioner was allotted work order for transportation and handling of the paddy from procurement centre. After completion of job petitioner has placed bill of Rs. 34,99,502/- after deduction of Rs. 78,721/- under the heading of Income Tax, the amount comes to Rs. 34,99,502/- which has been recommended by the District Manager of the Corporation,
Patna High Court CWJC No.9460 of 2016 (3) dt.25-01-2017 Bhojpur. He has given details of outstanding dues, including deduction made under Income Tax.
In such view of the matter, the Managing Director of the Corporation is directed to examine the case of the petitioner and release the fund without unnecessary delay. For convenient petitioner is directed to file representation along with the present order before the Managing Director of the Corporation who will dispose of the same after proper verification within a period of four weeks from the date of filing of the representation. With the aforesaid observation and direction this writ petition is disposed of.
