The petitioner seeks bail in a case instituted under Section 30(a) of Bihar Prohibition and Excise Act, 2016. It is alleged that 400 litres of country made liquor is said to have been recovered.

It has been submitted on behalf of the petitioners that the petitioner no.1 is in custody since 24.08.2017 and petitioner no.2 is in custody since 11.08.2017. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that 400 litres of country made liquor is said to have been recovered. There

Patna High Court Cr.Misc. No.49845 of 2017 (2) dt.17-10-2017 2/2 is no compliance of section 100 of the Cr.P.C. On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Nawada, in connection with Akbarpur P.S. Case No. 167 of 2017.
