The petitioner apprehends his arrest in a case registered under Section 379 of the Indian Penal Code. The gist of the allegation is that the petitioner was the driver of the tractor owned by the informant and he fled away with the tractor.

Learned counsel for the petitioner submits that the tractor is not in possession of the petitioner, rather some wages of the petitioner were lying due and the owner of the tractor has defaulted in making payment of the loan. That is why, this case is lodged.

It appears that the petitioner was entrusted with the tractor. The tractor is still missing.

Considering the facts aforesaid, I am not inclined to
