The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 323, 504 and 34 of the Indian Penal Code.

The sister-in-law of the petitioner filed complaint case alleging therein that her husband died on 14.01.2006, the petitioner being the younger brother of her husband produced forged papers showing oral partition of lands and wanted to sale the property. It is stated that during the lifetime of her husband, Motilal Sonar had taken the house on rent of which Title Suit No. 5 of 1995 is pending.

From the allegation itself, it appears that the dispute is with regard to partition of the property and no paper alleged to

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar Nagar P.S. Case No. 58 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
