The petitioner seeks bail in connection with Barauni P.S. Case No. 314 of 2017 registered under Sections 461, 379 and 411 of the Indian Penal Code.

Some unknown miscreants are said to have stolen cash of Rs. 2,50,000/-, lap top and mobile phone of the informant by breaking the lock of the room in the night in the absence of the informant.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. Stolen mobile was recovered from Reshmi

Patna High Court Cr.Misc. No.54264 of 2017 (2) dt.13-12-2017 2/2 Kumari, who happens to be sister-in-law of the petitioner which was handed over to her by him purchasing from Kundan Sada @ Kundan Das and he had no knowledge that the said mobile was stolen one. The petitioner has been languishing in custody since 03.09.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 314 of 2017.
