The petitioner apprehends his arrest in connection with Tajpur (Halai) P.S. Case No.514 of 2022 registered under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(c) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from the road near petrol pump. The petitioner has no concern with the alleged seized vehicle, liquor or place of recovery.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.18066 of 2023(2) dt.05-05-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Samastipur in connection with Tajpur (Halai) P.S. Case No.514 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
