JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-07-2019 Heard learned counsel for the petitioner, learned counsel for the O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Bhagalpur Sadar Mahila P.S. Case no. 10 of 2017, registered under Sections 498(A), 341, 323, 354(A), 504, 506 and 509/34 of the Indian Penal Code.
The accusation is of torturing of the informant Ranju Devi by her husband and other in-laws due to nonfulfillment of demand of dowry and removing her from matrimonial house along with her children snatching her personal belongings.
Learned counsel for the petitioner submits that on the joint prayer of the parties, the matter was referred to
Patna High Court CR. MISC. No.15807 of 2019(4) dt.22-07-2019 2/2 Mediation and Conciliation Centre, Patna High Court, Patna on 21.05.2019 for settlement of dispute between the petitioner and O.P. No.2, who are husband and wife, but O.P. No.2 did not turn up before the Mediation Centre due to that reasons, mediation between the parties, could not be succeeded. Further submission is that O.P.No.2, wife of the petitioner, had also filed Habibpur P.S. Case No. 05 of 2012 against the petitioner for the similar allegation in which petitioner is on bail and the said record is also going on for evidence, but O.P. No.2 did not appear in that case for giving her evidence.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Bhagalpur in connection with Mahila P.S. Case No. 10 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
