Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of theft is against unknown.

Submission is that nothing has been recovered from possession of the petitioner. Only material against the petitioner is confessional statement of the co-accused, namely, Pawan Pandey before the police. Petitioner is in custody since 13.06.2017.

Considering the aforesaid facts and the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.58278 of 2017 (2) dt.12-12-2017 2/2 each to the satisfaction of learned Court below where the case is pending in connection with Assaon Police Station Case No. 109 of 2016, subject to the condition that both the bailors are resident of territorial jurisdiction of the court below having immovable property and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
