This is a petition for grant of regular bail in connection with Paharpur P.S. Case No. 85 of 2018 for offences under Sections 379, 411, 414, 413 of the Indian Penal Code.

Accusation against the petitioner is that, while he was fleeing away, along with two others, after committing theft of motorcycle an alarm was raised they dashed against autorickshaw and fell down thereafter apprehended by the villagers with the motorcycle.

Learned counsel for the petitioner submits that there is no recovery of motorcycle from the conscious possession of the petitioner and since bail, on the ground of parity, to another coaccused Deepak Kumar Mishra was granted bail by a coordinate

Patna High Court Cr.Misc. No.46994 of 2018(2) dt.01-08-2018 2/2 bench of this court vide Cr. Misc. No. 40989 of 2018 and charge-sheet has been submitted in this case and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Paharpur P.S. Case No. 85 of 2018 to the satisfaction of the Chief Judicial Magistrate Motihari, East Champaran.
