JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioners are apprehending their arrest in connection with Sugauli P.S. Case No. 46 of 2015 for the offences instituted under Sections 304(B)/34 of the Indian Penal Code. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that informant's sister got married with co-accused, Dharmendra Kumar Sah one year before according to Hindu rite and customs. After some times, accused persons demanded one motor cycle and cash Rs. 1,00,000/- for doing business as dowry and when the demand was not fulfilled, they killed the victim.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.26715 of 2015 (2) dt.21-07-2015 2/2 petitioners are Debar and Nanad of the deceased. It is further submitted that the petitioners are separate in mess and property with the husband of the deceased and have no concerned with the affair of the husband of the deceased.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Sugauli P.S. Case No. 46 of 2015 on their furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
