JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 10.07.2020 in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the niece of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband and there is general and omnibus allegation against him.

Patna High Court CR. MISC. No.17582 of 2022(3) dt.02-01-2023 2/2 The deceased fell down on tube well due to slip of feet and became injured. She was taken to the hospital where she was declared dead. It is also submitted that there is no external injury in the postmortem report and the viscera has been preserved. The petitioner is in custody since 10.07.2020.

Considering the facts stated above and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, Xth, Darbhanga in connection with Manigachhi P.S. Case No. 148 of 2020, Sessions Trial No. 8 of 2021.
