JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147,148, 148, 364, 302 and 201 of the Indian Penal Code and Section 27 of Arms Act. The allegation against the petitioners and other coaccused is that they arrived at the house of the informant and caught his son Muchkund Kumar @ Sukul Singh and started assaulting the son of the informant. Thereafter the son of the informant was taken by the petitioners and others towards of the east of the village. Subsequently the informant heard the sound of firing. Ultimately the informant found the dead body of his son in a well.
It has been submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.26729 of 2015 (4) dt.24-09-2015 the petitioners have got no criminal antecedent. The petitioners have been falsely implicated in the present case due to previous enmity. The police, after investigation, has submitted final form in the present case but later on, again a petition for re-investigation has been filed on behalf of the prosecution.
On behalf of the State, it has been submitted that the petitioners are named in the FIR and a petition on behalf of the prosecution has been filed for -re-investigaion of the case. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai P.S.Case no. 119 of 2004, subject to the conditions as laid down u/s 438(2) Cr.P.C.
