======================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 03-03-2016 It has been submitted that the Trial has not concluded as yet and in the interest of justice this Court is proceeding to hear the matter.
The Petitioner seeks quashing of the order dated 06.04.2013 passed by the 11th Additional Sessions Judge, Saran at Chapra by which it has rejected the application for adducing the evidence of the witnesses named in the Petition i.e. Raj Deo Rai, Sheo Mangal Rai and Jangali Rai in S.Tr. No. 532 of 2012 arising out of Revelganj P.S. Case No. 27 of 2012.
The Petitioner seeks one day indulgence for examination of the witnesses.
In the interest of justice, the Trial Court is directed
Patna High Court Cr.Misc. No.916 of 2014 dt.03-03-2016 to give one day indulgence to the Petitioner to adduce the evidence of the witnesses after due notice to the accused persons within the next three weeks from the date of receipt of this order. However, if they fail to appear on the said date no further indulgence shall be given.
With the aforesaid observations, the Application stands disposed off.
