Petitioner apprehends his arrest in a case registered for the offence punishable under Sections 395,397 of the Indian Penal Code.

Informant has alleged that on 19.08.2019 at about 12:30 p.m., while he along with his wife were sleeping after taking meal, six unknown miscreants entered into his house and assaulted him, due to which he sustained injury on his head and, the accused persons committed loot of ornaments, cloths, utensils, cash of rupees fifty thousand etc. and thereafter they fled away with the aforesaid items on two motorcycles. It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case.

No.33008 of 2021(2) dt.26-10-2021 2/2 However, during investigation it has come that out of two motorcycles which were used by the miscreants for the purpose of burgling, one of them is found to be registered in the name of petitioner and petitioner has also two criminal antecedents.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to grant anticipatory bail to petitioner. Hence, the prayer for anticipatory bail of the petitioner is hereby dismissed.
