JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 307 and 379/34 of the Indian Penal Code. The prosecution case is that on 22.03.2016 at 9 AM while the informant was fencing his homestead land, all the named accused persons armed with lathi and sickle made protest and started assaulting the informant and when on alarm being raised, the nephew of the informant came to rescue then Sk. Minzan assaulted with sickle on his head causing bleeding injury. The accused persons also demolished the fence of the informant and snatched silver chain.
It is submitted by learned counsel for the petitioners that only one injury of the nephew of the informant has been found to
Patna High Court Cr.Misc. No.24268 of 2016 (2) dt.31-05-2016 2/2 be grievous which has been caused by Sk. Minzan who is not petitioner before this Court. The injury of the informant has been found to be simple in nature. The accusation against the petitioners is omnibus and general. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Amdabad P.S. Case No. 55 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
