IN THE HIGH COURT OF JUDICATURE AT PATNA

CIVIL MISCELLANEOUS JURISDICTION No.363 of 2016 ====================================================== Gyandeep .... .... Appellant/s

Versus

Chandra Shekhar Prasad & Ors .... .... Respondent/s ====================================================== Appearance :

For the Appellant/s : Mr. Bhagya Narayan Jha For the Respondent/s : Mr.

====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 05-08-2016 Heard the learned counsel, Mr. Bhagya Narayan Jha for the petitioner.

Perused the impugned order dated 21.04.2016 passed by Sub Judge IV, Munger in Title Suit No.144 of 1994. It appears that the Court below has considered all the submissions of the learned counsel for the petitioner and found that the so called adoption deed is unregistered deed. Therefore, unless the petitioner is declared to be the adopted son, he cannot be added as party in the suit.

The Court below has passed a very good reasoned order, therefore, it calls for no interference in supervisory jurisdiction. However, if so advised, the petitioner may approach appropriate forum by initiate appropriate proceeding for the redressal of the grievance.

Thus, this civil miscellaneous application is dismissed. Saurabh/- (Mungeshwar Sahoo, J) U T
