The petitioner apprehends his arrest in connection in connection with Jamhore P.S.Case No. 35/2015 registered for the alleged offences under Sections 420, 406, 409 of the Indian Penal Code.
Learned counsel for the petitioner submits that the matter is purely civil liabilities and there are various orders of the Hon'ble Court in support of his said contention. He further submits that although he had never stated before the Court below
Patna High Court Cr.Misc. No.28249 of 2015 (2) dt.22-07-2015 2/2 that he is ready to pay the dues in installment, which was not paid, but even then, he has been directed to deposit the dues in installment.
Under such circumstances, the petitioner seeks permission to withdraw this application, so that he may bring all these pleadings before the learned Sessions Judge, Aurangabad. Permission is accorded.
