ANJANA MISHRA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Khaira P.S. Case No. 28 of 2016 registered for the offences punishable under Sections 147, 341, 342, 323, 325, 307 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is an allegation against the petitioner for participating in an occurrence of assault on the informant, no specific role has been attributed to him. The main allegation is against one Mukhiya Ashok Yadav who is not the petitioner.

In view of the aforesaid facts and circumstances of the case and also that the petitioner has no criminal antecedent, let the

No.27849 of 2016 (2) dt.28-10-2016 2/2 petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 28 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
