JUSTICE RAJIV ROY ORAL ORDER 01-08-2025 Heard Mr. Gopal Krishna, learned counsel for the petitioner and the learned APP as also Mr. Kumar Dhirendra Pratap Singh, learned counsel representing the informant.

The present application has been filed for the cancellation of privilege of pre-arrest bail granted to the Opposite Party No.2 namely Bikas Kumar Sing @ Bikash Kumar Singh who has knowingly violated the term has and conditions directed in the order dated 31.01.2025 passed in Cr. Misc. No. 49706/24 by this Court.
3. The opposite party no.2 was granted anticipatory bail on 31.07.2025 after taking note of the fact that from June, 2024, the lady is getting maintenance of Rs. 17,896/- as also
Patna High Court CR. MISC. No. 24883 of 2025(4) dt.01-08-2025 2/3 that he will be taking her to his home. This followed their continuing the marital life under the same roof following which the anticipatory bail was granted.
4. Later, the present cancellation of bail was filed by the lady alleging that after he got the relief, they started torturing her, though, in between she became pregnant, torture continued which led to her moving out of the house to her parents place.
5. Counter affidavit has been filed on behalf of the husband and learned counsel submits that the Trial Court wanted the lady to come to her Court from where she could go with her husband. However, she failed to appear on the schedule date (15.04.2025). Learned counsel submits that being in SSB service, the O.P. No.2 knows about the repercussion of the torture/assaulting the lady and as such will not dare to do so. The lady is pregnant and he would like to ensure that she gives a trouble free birth of their child at his own place. He again undertakes that he/his family members shall be taking her back within a fortnight. The payment to her shall also continue as undertaken earlier.
6. Learned counsel for the petitioner has however provided the whats-app chat of the couple and this Court only
Patna High Court CR. MISC. No. 24883 of 2025(4) dt.01-08-2025 3/3 would like to record that the language that the husband has used is unbecoming of a SSB personnel and is enough to cancel the relief he was extended earlier. He is advised to be careful in future, else, can expect an adverse order.
7. Taking note of all the facts by the parties and recording that the husband-opposite party who is serving as SSB personnel shall be taking his wife with full dignity and honour and give financial help also, the present petition is disposed of. (Rajiv Roy, J) Ravi/- U T
