The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 326, 307, 379, 504, 506/34 of the Indian Penal Code and Section 27 of Arms Act.

As per FIR, the informant alleged that the petitioner shot fire upon his son namely, Sachin Kumar due to which he sustained gun shot injury on his left shoulder. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant and the petitioner both are full brothers and a land dispute is going on between them due this reason the petitioner has falsely been implicated in this case. There is no repetition of

As alleged only one injury sustained by informant's son which is opined by the doctor as simple in nature caused by firearm and in support of this, injury report of the injured has been annexed as Annexure-3. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 25.1.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hiramma P.S. Case No. 12 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheohar.
