The petitioner, who is husband of opposite party no. 2, apprehends his arrest in a case registered for the offence under Sections 341, 323, 498(A), 504, 506/34 of the I.P.C., Section 3 / 4 of the Dowry Prohibition Act and Section 66(B) of the I.T. Act.
Earlier, vide order dated 31.05.2023 passed by a coordinate Bench, the matter was referred to Mediation and Reconciliation Centre, Araria for exploring the feasibility of amicable settlement of dispute between the parties. In this regard, a report has been received from the Mediator, which is kept at flag 'A', and from perusal whereof, it appears that the
Patna High Court CR. MISC. No.17741 of 2023(3) dt.01-08-2023 2/2 dispute between the parties has been resolved on 'One Time Settlement'. Petitioner has been directed to pay Rs. 91,000/-, as one time settlement amount, to the informant/opposite party no. 2 and both parties have agreed for the aforesaid settlement. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Jokihat P.S. Case No. 387 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C. with further conditions: (i) Petitioner shall abide by the terms & conditions of the agreement arrived at before the Mediator. (ii) Petitioner shall hand over a bank draft of Rs. 91,000/- (Rupees ninety one thousand), as per agreement, to opposite party no. 2 at the time of furnishing bail-bond, otherwise his bail-bond shall not be accepted by the learned Court below.
