2. The petitioner has preferred this application for grant of regular bail in connection with Gaurichak P.S. Case No. 890 of 2025 registered for the offences punishable under Sections 316(2), 318(4), 303(2), 123 of the B.N.S.

3. As per the prosecution case, the petitioner, who happens to be the informant of this case, has alleged that the caretaker of the truck in question came and administered an intoxicating substance to him, after which he found himself at a different place in Muzaffarpur. It is further alleged that Rs. 34,000/- and two mobile phones were missing from his pocket, and when he reached the place of occurrence where the truck had been parked, he found that the same was missing

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the petitioner is the owner of the truck in question and has alleged that his truck is still missing. The name of the petitioner transpired on the basis of confessional statement of co-accused, Neeraj Kumar, who was a previous employee of the petitioner and used to work as the caretaker of the truck in question. The confessing coaccused, Neeraj Kumar, was fired from his job due to his previous misconduct, hence, he has falsely alleged against the petitioner. It has further been submitted that the petitioner is a patient of HIV. Lastly, it has been submitted that the petitioner has clean criminal antecedent and is in custody since 02.01.2026 although he was arrest on 29.12.2025.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

Heard the parties and perused the record, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna, in connection with Gaurichak P.S. Case No. 890 of 2025.
